On 13 September 2016, the Commission adopted a set of legislative proposals on copyright (accessible via https://ec.europa.eu/digital-single-market/en/modernisation-eu-copyright-rules). This package of proposals serves to modernise EU copyright rules and contains four legislative proposals including a proposal for a directive and a proposal for a regulation specifically addressing the implementation in EU law of the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired or Otherwise Print Disabled. In particular, the Commission's Proposal for a Directive of the European Parliament and of the Council on certain permitted uses of works and other subject-matter protected by copyright and related rights for the benefit of persons who are blind, visually impaired or otherwise print disabled and amending Directive 2001/29/EC on the harmonisation of certain aspects of copyright and related rights in the information society (COM (2016) 596; accessible via https://ec.europa.eu/digital-single-market/en/news/proposal-directive-permitted-uses-works-and-other-subject-matter-protected-copyright-and) aims at implementing the Marrakesh Treaty in the internal market by introducing a mandatory copyright exception in order to facilitate the access of people who are blind, have other visual impairments or are otherwise print disabled, to books and other print content in formats that are accessible to them, including across borders within the EU. 

The Commission's Proposal for a Regulation of the European Parliament and of the Council on the cross-border exchange between the Union and third countries of accessible format copies of certain works and other subject-matter protected by copyright and related rights for the benefit of persons who are blind, visually impaired or otherwise print disabled (COM (2016) 595; accessible via https://ec.europa.eu/transparency/regdoc/rep/1/2016/EN/1-2016-595-EN-F1-1.PDF) will govern the cross-border exchange of such accessible format copies between the EU and third countries that are parties to the Marrakesh Treaty. 

Discussions on these proposals have recently started in the Council. Council Working Party meetings were held on 3 and 17 October 2016. Further Council Working Party meetings on the Marrakesh Treaty are currently scheduled for November 2016. The proposals have been attributed to the Committee for Legal Affairs (JURI) as the responsible committee in the European Parliament. 

Meanwhile, the Advocate General delivered his conclusions in the pending request for an opinion of the Court of Justice of the European Union (CJEU) on the question of the ratification of the Marrakesh Treaty on 8 September 2016. In his opinion, the Advocate General concluded that the European Union has exclusive competence to conclude the Marrakesh Treaty, and proposed the Court to answer in that way. The Court's opinion is expected in the last quarter of 2016. 

Those proposals are complementary to the Commission proposal for an European Accessibility Act which requires ebooks to be accessible from the outset.

Huhu zusammen,

morgen ist wieder um 19:30 Uhr Mumble-Sitzung der AG Inklusive. Wer ist dabei? Hélder und ich haben morgen Flüchtlingsrat.

Dann noch ein weiteres Thema:
Der vKV Recklinghausen möchte im Frühjahr einen Poetry Slam zum Thema „Inklusive“ veranstalten. Hat jemand von euch Interesse Texte beizusteuern oder bei der Orga zu helfen?
