Dear Mr Roßner,

Thank you very much for your email and for the documents you submitted 
regarding the scheduling of cannabis under the 1961 UN Single Convention on 
Narcotic Drugs.

The European Commission presented a proposal for a Union position regarding 
the WHO recommendations on cannabis and cannabis-related substances. In line 
with our evidence-based approach to drug policy, this proposal was based on 
all available evidence provided by the WHO, UNODC, INCB, EMCDDA, our Member 
States, etc. We are also grateful for your submission and arguments you 
presented in this regard. 

The Commission proposal was discussed in the Horizontal Drugs Group of the 
Council and the Union position agreed on 23 November 2020.

As you are most probably aware, the Commission on Narcotic Drugs decided this 
2 December 2020 to support the deletion of cannabis and cannabis resin from 
Schedule IV of the Convention but rejected all other recommendations. The EU 
and its Member States issued an explanation of the vote the EU Member States 
expressed on the basis of the Union position as well as a press release.

I would also like to use this opportunity to draw your attention to the fact 
that the Court of Justice of the European Union examined the question whether 
cannabidiol (CBD) is covered by the UN Single Convention on Narcotic Drugs, 
as amended by the 1972 Protocol, in a judgment of 19 November 2020 in case 
C-663/18 [Commercialisation du cannabidiol (CBD)]. The Court of Justice 
concluded that CBD is not a “drug” within the meaning of the UN Single 
Convention on Narcotic Drugs (point 76 of the judgment) and consequently it 
is not considered as a drug either under the EU acquis, in particular Council 
Framework Decision 2004/757/JHA .

DG HOME is competent only for the narcotics aspects of cannabis as defined in 
the UN Single Convention on Narcotic Drugs. For all other aspects of your 
email, for example concerning global warming, food policy, energy, etc, I 
invite you to get in contact with the competent services of the Commission.
